May 5, 2025 | FAQS | By The Rossettis

What Is the Privacy Notice and Consent Form?

When you work with a REALTOR® in British Columbia, you will be asked to review and sign a Privacy Notice and Consent form. Developed by the BC Real Estate Association (BCREA), this form explains how your personal information is collected, used, and disclosed when you buy, sell, or lease property.

This isn't just paperwork—it's about ensuring your privacy rights are respected during your real estate transaction.

Common Questions About the Privacy Notice and Consent Form

Why do REALTORS® need my personal information?

REALTORS® collect personal information (like your name, address, property details, and financial info) to help market properties, facilitate transactions, and comply with legal obligations such as anti-money laundering laws.

Who will have access to my information?

Your information may be shared with:

  • Your REALTOR® and their brokerage
  • Real estate boards and the MLS® System
  • BC Financial Services Authority (BCFSA)
  • Real Estate Errors and Omissions Insurance Corporation
  • Government bodies like FINTRAC
  • Service providers such as appraisers, lawyers, and home inspectors

In some cases, information may also be stored outside Canada, where foreign laws could apply.

Can my information be used for marketing or future contact?

Yes, but only if you consent. The form separates primary uses (required to complete your transaction) from secondary uses (like receiving future marketing or surveys).

You can opt out of secondary uses by initialing the opt-out boxes next to those sections.

If I opt out, will it affect my ability to buy or sell property?

No. Opting out of secondary uses (like marketing follow-ups) won’t affect your transaction. REALTORS® still need your information for the essential parts of the sale or purchase.

Is signing this form mandatory?

While your consent is needed to handle your personal information for the transaction, you have choices about secondary uses. The form is designed to be transparent and give you control over how much additional communication (if any) you want.

Final Thoughts

The Privacy Notice and Consent form ensures that your personal information is handled responsibly throughout your real estate experience. Take the time to review it carefully, ask questions if you’re unsure, and remember—you have a say in how your information is used beyond the basics of your transaction.
