Musqueam and Canada Sign Historic Agreements Recognizing Rights, Stewardship, and Fisheries

The Musqueam Indian Band and the Government of Canada have signed three landmark agreements recognizing Musqueam’s Aboriginal rights and strengthening their roles in fisheries, stewardship, and marine emergency management. These agreements represent a significant step in reconciliation and the incremental implementation of Musqueam’s rights under Section 35 of the Constitution Act, 1982.

The agreements include:

  • Rights Recognition Agreement (šxʷq̓ʷal̕təl̕tən A) – Recognizes Musqueam’s Aboriginal rights, including title within their traditional territory, and establishes a framework for nation-to-nation collaboration.
  • Stewardship & Marine Management Agreement (xʷməθkʷəy̓əm) – Ensures that Musqueam knowledge and stewardship practices guide shared decision-making in the protection and management of waters and resources.
  • Fisheries Agreement (xʷməθkʷəy̓əm) – Supports collaborative fisheries management and provides funding for implementation, access, vessels, and gear.

Implications for Property in BC
According to the BC Real Estate Association (BCREA), agreements of this nature do not invalidate fee-simple title. Aboriginal title and fee-simple title are distinct legal concepts, each with its own characteristics and scope.
